Terms of Service

These Terms of Service ("Terms") govern your access to and use of TPO Budget, related app features, support pages, and hosted legal pages. By downloading, installing, accessing, or using TPO Budget, you agree to these Terms and to our Privacy Policy.

If you do not agree to these Terms, do not use TPO Budget.

Short version

  • TPO Budget is a privacy-first budgeting and personal finance app.
  • It is not a bank, broker, registered investment adviser, lender, money transmitter, tax adviser, legal adviser, or accounting firm.
  • The app provides tools, calculations, forecasts, and optional assistant features for informational purposes only.
  • Your core financial data is stored locally on your device. You are responsible for your device security, backup passwords, and exports.
  • Optional integrations (Plaid, Teller, Apple FinanceKit, iCloud, market data, cloud AI, text-to-speech) are governed by their own terms.
  • The app is provided "as is" and "as available" to the maximum extent allowed by law.

1. Who may use TPO Budget

You may use TPO Budget only if you can form a binding agreement under applicable law and are not prohibited from using the app by applicable law.

TPO Budget is not directed to children under 13. If you are under the age of majority where you live, you may use the app only with permission and supervision from a parent or legal guardian.

You are responsible for complying with all laws that apply to your use of the app.

2. App stores and platform terms

If you download TPO Budget through the Apple App Store, Google Play, TestFlight, Expo, or another distribution platform, your use may also be subject to that platform's terms, purchase rules, refund rules, update rules, and device requirements.

These Terms apply between you and The Path Out LLC. App-store providers are not responsible for TPO Budget, support, maintenance, claims, or the app's content except to the extent their own terms require otherwise. For iOS distributions, Apple and Apple's subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple's app distribution terms.

If these Terms conflict with mandatory app-store terms for a download, purchase, refund, or update handled by that store, the app-store terms control for that store-specific issue.

3. License to use the app

Subject to these Terms, The Path Out LLC grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use TPO Budget on devices you own or control, for your personal or household budgeting and financial organization.

4. Your data and responsibilities

You own the financial records, notes, categories, settings, exported files, and other content you create or import into TPO Budget.

Because TPO Budget is local-first, The Path Out LLC usually cannot access, recover, correct, export, or delete data that exists only on your device. You are responsible for:

If you lose your device, delete the app, forget a backup password, erase local storage, or overwrite a backup, your data may be permanently unrecoverable.

5. Optional integrations and third-party services

TPO Budget can connect to optional third-party services only when you choose to enable them. These may include Plaid, Teller, Apple FinanceKit, iCloud, market data providers, OpenAI, Anthropic, OpenRouter, Groq, ElevenLabs, custom AI providers, your bank, your app store, your email provider, your cloud storage provider, and system share destinations.

Third-party services are not controlled by The Path Out LLC. They may have their own terms, privacy policies, fees, outages, limits, eligibility rules, data practices, and support processes. You are responsible for reviewing and following those third-party terms.

The Path Out LLC is not responsible for third-party services, third-party data, provider outages, provider policy changes, account restrictions, inaccurate provider responses, or any loss caused by a third-party service.

6. No banking, brokerage, or money movement

TPO Budget is a budgeting and personal finance organization tool. It is not a bank account, deposit account, stored-value account, wallet, broker-dealer account, investment account, loan product, payment service, money transmitter, tax service, insurance product, or credit-repair service.

The app does not custody your money, hold securities, execute trades, initiate real-world payments, send money, lend money, or settle transactions. Any transfers, payments, account balances, or investment entries shown in the app are records, imports, estimates, or user-entered information unless a future feature clearly states otherwise.

Always verify important financial information with your bank, broker, card issuer, tax professional, legal adviser, or other authoritative source.

7. No professional advice

TPO Budget may show budgets, forecasts, categorizations, net-worth views, debt-payoff scenarios, tax-efficiency prompts, estate-readiness prompts, cash-flow projections, assistant answers, AI-generated summaries, market prices, or other financial information.

Those features are for informational and organizational purposes only. They are not professional advice and should not be treated as financial, investment, legal, tax, accounting, insurance, credit, debt, estate-planning, or retirement advice.

You are solely responsible for financial decisions you make. Before making important financial, tax, legal, investment, insurance, credit, estate, or debt decisions, consult a qualified professional.

8. Accuracy and availability

TPO Budget depends on user input, local device state, imported files, third-party providers, market data, operating-system services, AI models, and network availability. Information in the app may be incomplete, delayed, duplicated, miscategorized, inaccurate, unavailable, or lost.

We do not guarantee that:

Use the app as one tool among others. Do not rely on it as your only record or your only source of financial truth.

9. AI, voice, and generated output

If you use Guardian AI, cloud AI, voice input, cloud text-to-speech, or bring-your-own-key providers, outputs may be incorrect, incomplete, outdated, or unsuitable for your situation.

You are responsible for reviewing and confirming any suggested action before relying on it. The app may ask you to confirm certain actions before writing to the local database, but you remain responsible for the result.

Do not enter or send information to an AI, voice, text-to-speech, or custom provider unless you are comfortable with that provider processing it under its own terms and policies.

10. Backups, exports, and passwords

TPO Budget provides user-controlled export, import, restore, local backup, encrypted backup, iCloud backup, diagnostics export, privacy audit export, and reporting features.

You are responsible for deciding what to export, where to store exported files, who receives them, and how they are protected. Plain CSV exports and some local backup contents may be readable by anyone who has access to the file.

Encrypted backups may be unrecoverable if you lose the password or key material. The Path Out LLC may not be able to reset, recover, decrypt, or restore your backup.

11. Fees, purchases, and refunds

TPO Budget may be offered for free, as a paid download, with paid features, or with subscriptions depending on the platform, release channel, and version.

If a purchase, in-app purchase, subscription, refund, cancellation, tax, trial, or billing issue is handled by an app store or payment provider, that store or provider's terms and refund policies apply. The Path Out LLC does not control app-store billing systems or refund decisions.

Any paid feature should display the applicable price and billing terms before purchase. Taxes, carrier fees, data fees, exchange rates, and provider charges may apply and are your responsibility unless applicable law says otherwise.

12. Support and diagnostics

If you contact support, you choose what information to share. We may ask for screenshots, descriptions, or diagnostics exports to investigate an issue. Do not send sensitive financial information unless you intentionally choose to do so.

We may not be able to troubleshoot issues caused by device settings, operating-system changes, provider outages, bank restrictions, app-store policies, third-party services, corrupted local data, forgotten passwords, or unsupported configurations.

13. Changes to the app or terms

We may update, modify, suspend, remove, limit, or discontinue any feature of TPO Budget at any time, including optional integrations, proxy behavior, AI features, market pricing, backup features, reports, or support channels.

We may update these Terms from time to time. If changes are material, we will update the effective date and make the revised Terms available in the app or on the hosted Terms page. Because TPO Budget does not require an account or email address, we may not be able to notify every user directly.

Your continued use of TPO Budget after updated Terms are made available means you accept the updated Terms. If you do not agree, stop using the app.

14. Termination

You may stop using TPO Budget at any time. You can delete local app data through available app controls, operating-system settings, or uninstall flows.

We may suspend or terminate your access to any service we control, including proxy services or support channels, if we believe you violated these Terms, created security risk, abused the service, violated law, or caused harm to users, providers, systems, or The Path Out LLC.

Termination does not automatically delete local data stored only on your device or files you exported elsewhere.

15. Intellectual property and feedback

TPO Budget, the website, software, designs, text, graphics, logos, trademarks, code, documentation, and related materials are owned by The Path Out LLC or its licensors and are protected by intellectual-property laws.

You may send suggestions, feedback, ideas, bug reports, or feature requests. If you do, you grant The Path Out LLC a perpetual, worldwide, irrevocable, royalty-free license to use that feedback without restriction or compensation to you.

17. Disclaimers

To the maximum extent permitted by law, TPO Budget and related services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.

The Path Out LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, non-infringement, availability, security, and compatibility.

Some jurisdictions do not allow certain warranty disclaimers, so some of these disclaimers may not apply to you.

18. Limitation of liability

To the maximum extent permitted by law, The Path Out LLC and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, backups, credentials, business, financial opportunity, investment value, or other intangible losses.

To the maximum extent permitted by law, The Path Out LLC's total liability for all claims related to TPO Budget or these Terms will be limited to the greater of:

These limits apply regardless of legal theory and even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain liability limitations, so some limitations may not apply to you.

19. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Path Out LLC and its owners, employees, contractors, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

You may not use, export, re-export, or transfer TPO Budget except as permitted by United States law and any other applicable law. You represent that you are not located in a country or region subject to applicable embargoes or sanctions and are not listed on any applicable restricted-party list.

You may not use TPO Budget for any purpose prohibited by applicable law.

21. Governing law

These Terms are governed by the laws of the United States and the state in which The Path Out LLC is organized, without regard to conflict-of-law rules, except where applicable law requires otherwise.

Any dispute that cannot be resolved informally will be brought in the state or federal courts located in that state, unless applicable law requires a different forum.

22. Miscellaneous

These Terms and the Privacy Policy make up the agreement between you and The Path Out LLC for TPO Budget.

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
